Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASING WILL NOT INCREASE YOUR CHANCES AT WINNING.
SWEEPSTAKES DATES: “June Dairy Month” Sweepstakes (the “Sweepstakes”) begins 12:01 am ET on June 1, 2009 and ends 11:59 pm on August 15, 2009 (the “Sweepstakes Period”). Entry forms distributed in store while supplies last.
ELIGIBILITY: The sweepstakes is open to all legal permanent United States residents residing in the states of Florida, Georgia, South Carolina, Alabama, and Tennessee who are 18 years of age or older with a unique valid Social Security number at the time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of Publix Super Markets, FRFCF, their subsidiaries, and each of their respective parent companies, divisions, affiliates, distributors or advertising and promotional agencies, and any others involved in the production, development, execution or distribution of this sweepstakes, herein (the “Sweepstakes Entities”) are not eligible to participate. Sweepstakes is void outside the states of FL, GA, SC, AL, and TN and wherever else prohibited or restricted by law.
HOW TO ENTER: There are two (2) ways to enter:
1) ONLINE/IN-STORE ENTRY FORM: Visit www.coolfoods.org and go to the “Official Entry Form” link to download and print the Official Entry Form OR visit a participating Publix location to obtain the Official Entry Form at the "Healthy for the Whole Herd - June Dairy Month Standee". Complete the Official Entry Form in its entirety including your full name, physical address, city, state, zip code, date of birth, and phone number.
2) MAIL-IN: Complete a hand printed 3 ½-inch x 5-inch postcard to include your full name, physical address, city, state, zip code, date of birth, and phone number.
Send all entries in a self addressed #10 stamped envelope to: “June Dairy Month”, 90 Rockwood Place, Rochester, NY 14610. All entries must be postmarked by August 15, 2009 and received by August 24, 2009. Limit of one (1) entry per envelope. Neither Sponsor nor any Sweepstakes Entity is responsible for lost, late, stolen, misdirected, damaged, undeliverable, mechanically reproduced, impermissible, illegible, postage due or incomplete entries, regardless of cause. Neither the Sponsor nor Sweepstakes Entities will verify receipt of entries for entrants. All entries submitted become the sole property of Sponsor and will not be returned. No mechanically or programmatically reproduced entries are permitted.
Enter as often as you like. Limit: one (1) entry per envelope.
Neither Sponsor nor any Sweepstakes Entity is responsible for any technical, electronic, cash register, telephone, hardware, software or network, computer or data transmission errors, malfunctions or difficulties of any kind. Entries are null and void and will be rejected if not obtained through authorized legitimate channels or if any part is altered, defaced, counterfeited, mutilated or tampered with in any way.
DRAWING: Grand Prize Winner will be selected in a random drawing from among all eligible entries received. First and Second Prize Winners will be selected in a random drawing from among all eligible entries received for that region. Regions are broken out as follows: 1. Atlanta 2. Jacksonville 3. Lakeland and, 4. Miami. The drawings will be held on or around August 28, 2009, and will be conducted by independent judging organization, The National Sweepstakes Company, whose decisions are final based on their sole discretion and interpretation of these official rules, and are final and binding in all respects.
ODDS:
Grand Prize: Odds of winning are dependent upon the total number of eligible entries received during the Sweepstakes Period.
First and Second Prize: Odds of winning are dependent upon the total number of eligible entries received for that region during the Sweepstakes Period.
PRIZES:
Grand Prize: One Grand Prize of Free Groceries for a Year. Grand Prize will be awarded in the form of $10,400 in Publix Gift Cards, equal to $200 per week for 52 weeks. Approximate Retail Value (“ARV”) of the Grand Prize is $10,400.
First Prizes: Four (4) First Prizes of a $1000 Publix Gift Card. Total ARV of all First Prizes is $4,000.
Second Prizes: One Hundred (100) Second Prizes of a $100 in Publix Gift Cards. Total ARV of all Second Prizes is $10,000.
Prizes will be awarded as Publix Gift Cards. Publix Gift Cards have no cash value and are subject to all terms and conditions on the cards and of the Publix Gift Card program, available at the customer service desk in Publix stores. Gift Cards are redeemable only at Publix stores. Use of prize Gift Cards for purchase of certain products may be limited if required by law. Gift cards must be used within 12 months after issue date. Winner is responsible for all other expenses associated with his/her use of the prize not specified here. Prizes are non-transferable, non-exchangeable, have no cash value, and cannot be extended or replaced if lost, destroyed, stolen, or unredeemed. Sponsor reserves the right to substitute a prize of equal or greater cash value. Limit one (1) prize per household. Sponsor is not responsible for winner limitations that prevent acceptance or use of any prize.
WINNER NOTIFICATION/RELEASES: Winners will be notified by telephone or by mail within seven (7) days of the drawing. Except where prohibited, Grand and First Prize winners must sign and return, within five (5) business days of receipt, an Affidavit of Eligibility/Liability/Publicity Release form, and IRS W-9 form (the “Paperwork”) in order to claim prize. If potential Grand or First Prize winner cannot be contacted within seven (7) days from the date of the first attempt to contact him/her or if he/she fails to sign and return the Paperwork within five (5) business days of the date notified, potential Grand or First Prize winner forfeits their right to the prize and an alternate winner will be selected. (TN residents will not be required to sign a Release as a condition of winning a prize)
Entry constitutes permission to use winner's name, voice, and likeness for advertising or promotional purposes without approval or further compensation for such use unless prohibited by law. Prize winner may be issued an IRS 1099 form for the actual value of the prize for the year in which actual prize value was received.
GENERAL RULES OF PARTICIPATION: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsor reserves the right to disqualify from this Sweepstakes any entrant it believes has violated these Official Rules. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (in whole or in part), then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the prize winners in a manner deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on Sweepstakes website. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By participating, participants agree to release, indemnify, hold harmless and agree to defend Publix Super Markets, FRFCF, their parents, subsidiaries, affiliates, and agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages, injuries or losses to persons or property which may be sustained in connection with participation in the Sweepstakes and/or the receipt, ownership or use/misuse of any prize, or while preparing for, participation in, and/or traveling to any Sweepstakes-related activity.
WINNERS LIST: A Winners List, available after August 31, 2009, can be obtained by sending a separate self-addressed, stamped envelope to: “June Dairy Month” Sweepstakes Winners list, PO Box 46787, Tampa, FL 33646. Request for the winners list must be postmarked by September 30, 2009.
This sweepstakes is being conducted in the states of Florida, Georgia, South Carolina, Alabama, and Tennessee and is not valid in any other states or territories of the United States.
